By creating an account and ticking the checkbox during signup, you confirm that you have read, understood, and agreed to these Terms & Conditions in full. If you do not agree, you must not access or use the EIGHTLUX platform.
These Terms form a legally binding agreement between you ("Member") and Studio Barakat Pty Ltd ("we", "us", "EIGHTLUX").
2.1 Plans. EIGHTLUX offers two membership plans: "Start Planning" (free) and "Full Access" (a single one-time payment). There are no subscriptions, no recurring charges, and no automatic renewal on either plan.
2.2 Start Planning (free plan). The free plan provides limited access to selected content and tools so you can explore the platform. Premium content is not included and remains locked on the free plan.
2.3 Full Access (one-time payment). Full Access is granted upon a single one-time payment at the price displayed at checkout. Payment unlocks all premium content and tools immediately, for the duration your account remains in good standing under these Terms. Prices are in Australian dollars and may change for new purchases at any time; a price change does not affect access already purchased.
2.4 Upgrades. A member on the free plan may upgrade to Full Access at any time by completing the one-time payment, after which full access is granted immediately.
2.5 Refunds. Payment for Full Access is non-refundable once any premium content has been accessed, given the digital and immediately consumable nature of the materials. Nothing in this clause limits any rights a customer may have under the Australian Consumer Law that cannot lawfully be excluded.
EIGHTLUX membership is available to private individuals only - specifically, people planning a personal marriage proposal for their own use.
The following are strictly prohibited from using this platform: - Professional proposal planners, event planners, or wedding planners - Proposal photography or videography businesses - Florists, stylists, venue coordinators, or any supplier operating in the proposal or wedding industry - Any business, sole trader, partnership, company, or entity that derives income from proposal or wedding-related services - Agents, consultants, or representatives acting on behalf of any of the above
If you fall into any of the above categories, you are not permitted to sign up, access, or benefit from this platform in any capacity - even for personal use. Doing so constitutes a breach of these Terms.
Upon purchasing a membership, Studio Barakat Pty Ltd grants you a limited, non-exclusive, non-transferable, personal licence to access and use the digital content available on the platform solely for your own private, non-commercial proposal planning.
This licence does not permit you to: - Copy, reproduce, download, or store content beyond what is reasonably required for personal viewing - Print, export, or save content for distribution or resale - Share, forward, or provide access to any content to another person, whether for free or for payment - Use any content as the basis for a service, product, or offering provided to a third party - Incorporate any content into a business workflow, client deliverable, or professional process - Adapt, translate, modify, or create derivative works from any content on this platform - Upload any EIGHTLUX content to any third-party platform, cloud service, or AI tool for commercial purposes
EIGHTLUX content - including but not limited to guides, templates, budget planners, timelines, vendor directories, style quizzes, and any other downloadable or viewable material - is created for personal use only.
You must not: - Use any EIGHTLUX content, in whole or in part, to offer, advertise, or deliver services to a paying or non-paying client - Package, rebrand, or resell EIGHTLUX content under your own name or any other brand - Include EIGHTLUX content in any proposal, pitch, presentation, or service offering made to another person - Use EIGHTLUX content to train AI systems, build competing products, or develop tools for commercial distribution - Print and physically distribute, sell, or gift EIGHTLUX content in any format
Any commercial use - direct or indirect - is a material breach of these Terms and may result in immediate account termination and legal action.
Studio Barakat Pty Ltd actively monitors for misuse of its content and intellectual property.
If we determine, at our sole discretion, that you have breached these Terms - including any commercial use, unauthorised sharing, or professional misuse - we reserve the right to: - Immediately suspend or permanently terminate your membership without refund - Pursue civil legal action for breach of contract - Seek damages, including lost profits and costs associated with enforcement - Seek an injunction to prevent ongoing misuse - Report the breach to relevant professional bodies or platforms where applicable - Publicly assert our intellectual property rights
You acknowledge that the content on this platform constitutes proprietary intellectual property of Studio Barakat Pty Ltd, and that unauthorised use may cause significant commercial harm for which monetary damages alone may be insufficient.
All content on the EIGHTLUX platform - including text, graphics, templates, layouts, tools, and designs - is owned by or licensed to Studio Barakat Pty Ltd and is protected under Australian copyright law and applicable international treaties.
Nothing in these Terms transfers ownership of any intellectual property to you. Your membership gives you access to content; it does not give you ownership of it.
You are responsible for: - Keeping your login credentials confidential - All activity that occurs under your account - Ensuring no other person (including a partner, friend, or colleague) uses your account
Sharing account access is a breach of these Terms. Each membership is for one individual only.
All payments are non-refundable once any content under the corresponding plan has been accessed, given the digital and immediately consumable nature of the materials. By completing your purchase, you acknowledge that you receive access to digital content and waive any right to a refund in those circumstances, to the maximum extent permitted by law.
Nothing in this clause excludes, restricts or modifies any right or remedy you may have under the Australian Consumer Law that cannot lawfully be excluded.
If you believe there is a genuine technical issue preventing access, contact us at info@studiobarakat.com.au or hello@eightlux.com.au within 48 hours of purchase.
EIGHTLUX content is provided for general planning guidance only. We do not guarantee specific outcomes from using our content and are not liable for decisions made based on the information provided on this platform.
Vendor suggestions and pricing estimates may not be current. Always verify details independently before making bookings or financial commitments.
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.
We may update these Terms at any time. Continued use of the platform after any update constitutes acceptance of the revised Terms. We will notify members of material changes via email where practicable.
